Construction Law

The staff members of our law firm have long time experience in the various fields of construction law, of which only the most important ones shall be described here:

  • private construction law
  • public construction law
  • law of project management, architectural and engineering law
  • plant construction

We support you in the drafting of contracts and in the contract management of counsel and if necessary, in litigation in court. In negotiations with authorities, investors or third parties we develop solutions to safeguard unhindered construction and planning processes and approval procedures. In this context, we provide counsel for construction projects of all sizes, as well for principals as for contractors.

In addition, we offer various seminars in this area of law which are intended to serve especially to employees in non-legal fields as well as in the legal departments of our clients.

Private Construction Law

We support your construction projects from their very beginning with competence and swift implementation. We assist and advise you in choosing the adequate type of contract, the concept, the examination and negotiation of single clauses and entire agreements as well as in the contract management. In this context, legal counsel during the construction period is an important pillar in order to document and to secure your rights and claims already during the construction phase.

Thanks to profound knowledge of the legal, economic and chronological requirements in this field we also advise you in all questions of change and follow-up management.

Although we are also active in the fields of structural and civil engineering and road construction, the main emphasis of our work lies in the area of track construction. Due to our long-standing experience in this specific field – particularly in projects of the DB and its affiliates – our colleagues have not only the tactical know-how, but also good contacts to allow them to find solutions for arising problems.

Law of project management, architectural and Engineering Law

Architectural and engineering law has, due to the revised version of the schedule of services and fees for architects and engineers (HOAI) and a multitude of different court decisions, become a very complex issue. In most cases, the legal responsibility of the architect/engineer and questions of fees are first and foremost already at an early stage one’s attention should be directed with care at the drafting of the agreements in order to prevent later conflicts from arising. For this purpose, all legal relation have to be clearly defined.

In the context of all these questions (and also in drafting project management, engineer general planner and controller agreements) we would like to actively advise and support you.

Plant Construction

Traditionally, mechanical engineering and plant construction form part of the five most important sectors in Germany with revenues of approximately 500 billion Euro.

Within this particularly complex field, besides of the technical requirements, there exist many legal questions, which have to be resolved before or during the operational processing of such a project.

On the basis of our long term experience we support the parties involved in the drafting of the agreements as well as in the operational handling.
